Terms of purchase

  1. Introduction

Contractual parties : These terms of purchase ("Terms of Purchase") apply to agreements for the purchase of Products entered into between 3DVue AB with registration number 559390–7123 (hereinafter referred to as the "Seller") and the consumer or trader who completes the order (hereinafter referred to as the "Customer") via the Web store . The Seller and the Customer are referred to below collectively as the "Parties" and individually as a "Party".

Contract period: The terms of purchase apply from the day the Customer accepts them. The purchase agreement including these Terms of Purchase is valid until the delivery has been made and the Seller has received the payment. Provisions in the Terms and Conditions regarding dispute resolution and any other provisions which are expressly or with regard to their nature intended to apply even after the fulfillment of the agreement, shall, however, continue to apply even after the agreement has been fulfilled.

Acceptance of the Purchase Terms : By completing the purchase, the Customer certifies that he has read and accepts the Purchase Terms and that he undertakes the obligation to comply with them.

Electronic communication : The Customer agrees that the Seller conveys information, documentation and documents regarding the purchase via e-mail, SMS or other form of electronic communication to the Customer's specified contact details.

Consumer protection legislation : If the Customer is a consumer, the Act (2005:59) on distance contracts and agreements outside business premises ("Distance Contracts Act") and the Consumer Purchase Act (2022:260) apply to the mandatory rules on the rights and obligations of consumers and traders in the contractual relationship between the Parties.

 

  1. Definitions

In addition to the terms defined in the running text of these Terms and Conditions, the following definitions shall have the following meaning when capitalized as the initial letter, regardless of whether they are used in the plural or singular, in definite or indefinite form:

Payment service provider : refers to a third party that, among other things, processes payments from Customers or performs invoicing on behalf of the Seller.

GDPR : Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free flow of such data and on the repeal of Directive 95/46/EC (General Data Protection Regulation) .

Customer : refers to the consumer or trader who orders Products from the Seller via the Web Store.

Products : refers to the Products that are sold by the Seller via the Online Store at any given time.

Product page: A page in the Website that refers to a Product, with information about, for example, the Product's price, Product description, stock status, delivery time, etc.

Third party : refers to someone other than the Customer or the Seller.

Web store : refers to www.3dvue.se .

 

  1. Buy

Age limit : Customer as a consumer must be at least 18 years of age and of legal age to have the right to enter into the purchase agreement with the Seller and complete the purchase. By completing the purchase, the Customer certifies as a consumer that he is at least 18 years old and that he has the right to enter into this legally binding agreement independently.

Signatory : The natural person who completes the purchase in the capacity of authorized signatory for the trader, legal person or organization represented, hereby certifies that he or she has the right to enter into the purchase agreement with the Seller and that the Purchase Terms become binding between the Parties.

Binding agreement : A binding agreement for purchase between the Parties is only entered into when the Seller has confirmed the order through an order confirmation sent to the e-mail address that the Customer has specified in connection with the purchase.

Order confirmation : In the order confirmation, the Customer will find all information about the purchased Products, price, billing and delivery address. If the Customer discovers an error in the order confirmation, the Customer must immediately contact the Seller via e-mail: kontakt@3dvue.se . If, against the assumption, the Customer has not received an order confirmation after completing the order, the Customer should first check the spam folder and then contact the Seller if necessary. In the event of any inaccuracies in e.g. indication of price, delivery time, etc. the Seller reserves the right to correct this afterwards.

Fulfillment of the agreement : The customer has fulfilled his part of the purchase agreement when the customer has made full payment for the order. The seller has fulfilled his part of the purchase agreement when complete delivery of purchased Products has been completed.

 

  1. Prices and discounts

Price : All prices in the Web shop are stated in SEK and all prices include VAT. The price stated in connection with the order/in the order confirmation is the price that applies to the purchase, provided that the price is not clearly incorrect or the Customer acted in bad faith. The seller has the right to freely change the prices published in the Web store at any time.

Reservations : The Seller reserves the right to price changes caused by a price change from the supplier, misprints in the price list and inaccuracies in prices due to incorrect information and reserves the right to adjust the price and any factual errors that may be found on the Online Store or in the Seller's advertisements.

Discounts: Discounts cannot be redeemed for cash, or be combined with other offers. This applies unless expressly stated otherwise. Discount offers are valid for a limited time. Discount offers can only be availed if stated within the validity period and prior to order completion. Furthermore, it is only possible to use discount offers once (1) per order, unless otherwise stated.

Promotions: Offers and campaigns marketed on the Web store are valid while stocks last if no other conditions are stated in connection with the offer. Any special campaign conditions apply only during the campaign's validity period. What is stated in this clause applies provided that nothing else is explicitly stated in connection with the campaign.

 

  1. Payment

Payment can be made through the payment methods available at any time that are offered via the Web store by the integrated Payment Service Providers. Currently, the following payment solutions are offered:

  • Clear check-out,
  • Card payment with Visa, Maestro and Mastercard via Shopify payment, and
  • PayPal via Shopify payment.
  • Invoice

The Customer is hereby informed that the Customer accepts the Payment Service Provider's terms and conditions and the processing of personal data that the Customer provides in connection with the purchase, when the Customer makes a payment via the Payment Service Provider's payment service. The customer is responsible for reading the payment service provider's terms and conditions before completing the purchase.

Invoice

The invoice is delivered via e-mail to the e-mail address you enter at the time of purchase and must be paid within 30 days from the invoice date. In case of late payment, a reminder will be sent to you and a late fee of SEK 60 will be charged. In the event of further delay, a statutory debt collection fee is added. We use Visma Amili AB for reminder fees and debt collection matters.

In the case of invoice purchases, we reserve the right to make a credit report. Collection and processing of personal data and credit information is necessary for us to be able to process your request for 30-day credit.

 

  1. Delivery/Shipping Terms

The customer is responsible for registering correct information in connection with the order, for example customer details, contact details and delivery address.

Regarding Products that are in the Seller's own warehouse, the Seller's normal delivery times are 1–3 weekdays. ATTENTION! Orders placed on weekends are sent on the following Monday at the earliest (non-holiday weekdays).

The shipping cost is presented at checkout.

Orders over a certain amount receive free shipping ( DHL Service Point ) ( Postnord ).

If delays in delivery should occur (without the Seller notifying the Customer of a longer delivery time), the Customer must contact the Seller at e-mail address: kontakt@3dvue.se. However, a complaint due to delay does not mean automatic cancellation of the purchase agreement. The seller has the right, after receiving a complaint, to remedy the delay and complete the purchase within a reasonable time.

If it is not possible to complete the delivery, the Product in question will be cancelled, and the Customer will be refunded the amount that the Customer has paid for the Product in question.

Customer as a consumer : The products are delivered to agents via DHL Service Point or Postnord mypack collect . The products are sent to the Customer's nearest delivery point (DHL Service Point) (Postnord delivery point).

Customer as a trader : The products are delivered by agents via DHL Paket or Postnord Parcel directly to the specified delivery address.

Unclaimed packages

The customer is responsible for redeeming the shipment at the delivery point within the time stated on the invoice.

Unclaimed packages are returned to the sender of the shipment in question. For all packages that are not redeemed, the Seller reserves the right to charge the Customer costs for return shipping, handling fee and handling fee, currently SEK 195.

Customer cancellation

If the Customer cancels an ordered Product before it has been delivered, the Seller is entitled to compensation for:

  1. special costs that the Seller has had to enter into and fulfill the agreement to the extent that the Seller cannot absorb these in any other way,
  2. special costs resulting from the cancellation or cancellation, and
  3. loss in general with an amount that is reasonable taking into account the price of the product, the time of cancellation or cancellation, the extent of work carried out and the circumstances in general.

Special conditions for the purchase of 3D printers and spare parts for 3D printers

The seller does not stock 3D printers or spare parts for 3D printers that are sold via the Web store. It is the supplier of the ordered 3D printer and/or the spare parts that carries out the delivery to the delivery address that the Customer has specified in connection with the order, on behalf of the Seller.

The Seller does not check these Products before they are delivered to the Customer by the supplier, as the Seller neither manages the packaging nor the delivery of these Products.

The estimated delivery time for 3D printers or spare parts for 3D printers is 3-5 business days.

In the event of a product warranty claim regarding a purchased 3D printer and/or spare part for a 3D printer, the Customer must contact the Seller, who then contacts the supplier in question to handle and investigate the matter.

The customer is responsible for installing and using the 3D printer in accordance with the accompanying instructions. Customer accepts and understands that the Seller cannot be held responsible for the Customer's incorrect installation or handling of the 3D printer.

If a purchased 3D printer shows an error message that the Customer is unable to solve on their own, the Customer must contact the Seller to try to solve it together.

  1. Open purchase/Right of exchange/Right of withdrawal

7.1 Open purchase or right of exchange

The seller does not apply open purchase or exchange rights.

7.2 Right of withdrawal

Customers in their capacity as consumers may have the right to cancel their purchase (right of cancellation) that was carried out remotely according to the Distance Contracts Act. The right of withdrawal means that the consumer has the right to withdraw from the contract within the withdrawal period without giving any reason, provided that the conditions for the right of withdrawal are met. The cancellation period is 14 days and begins the day after the consumer receives the product. If the consumer has purchased several goods or a product consisting of several parts, the withdrawal period is counted from the day the consumer receives the last product or the last part of the product. The right of withdrawal applies only to consumers.

The Consumer has the right to open the package to examine the Product (but not the vacuum packaging), to determine its functions and properties, but if a reduction in value has occurred due to the Consumer handling the Product to a greater extent than was necessary to determine its properties or function, the consumer must reimburse the Seller for the reduction in value.

7.3 Invoking the right of withdrawal

The Customer must always inform the Seller that he wishes to invoke the right of withdrawal before he returns any Products, so that the Customer receives instructions and the correct return address for the Product in question. Products must be returned to the return address designated by the Seller.

If the Customer chooses to use his right of cancellation and has the right to cancel, the Product must be returned to the Seller, in any way and well packaged, at the latest within 14 days from the day the Customer notified the Seller that the Customer wishes to exercise his right of cancellation.

The customer is responsible for return shipping and the Products should be sent well packaged and in their original packaging.

If the Customer returns the Product by exercising its right of withdrawal to the return address notified by the Seller, the Seller will make a refund within 14 days from the date the Seller received the Customer's notification that the right of withdrawal is exercised, provided that the Seller has also received the Product in return or that the Customer has provided proof of The seller that the Product has been returned. From the refund amount, the Seller reserves the right to deduct an amount corresponding to the decrease in value compared to the goods' original value in the case of a used or damaged Product.

The Seller will refund the amount paid for the Product, less any reduction in value that has occurred due to the Customer's handling of the returned Product, shipping costs and other overheads.

The payment method for the refund is the same as that used by the Customer at the time of purchase, unless the Parties have expressly agreed otherwise.

Notification of exercising the right of withdrawal must be submitted within the withdrawal period. If the Customer wishes to exercise his right of withdrawal, the Seller must be notified of this via e-mail to kontakt@3dvue.se or by post to Fågelsångsgatan 9, 268 77 Kågeröd. The right of withdrawal can also be exercised by using the withdrawal form that can be downloaded via the following link: withdrawal form , and sending the completed withdrawal form to the Seller. In the Customer's message, the Customer's name, address, e-mail address, order number and which goods the return applies to must be clearly stated.

 

  1. Complaint

Should the Product be damaged or mis-shipped when it arrives, the Seller undertakes, in accordance with current consumer protection legislation, to rectify the error free of charge.

The Customer must always contact the Seller at kontakt@3dvue.se for approval before the Customer returns a defective item or a 3D printer.

The complaint must be sent within a reasonable time from when the Customer noticed or should have noticed the fault. Notification of invoking a fault through a complaint that takes place within two (2) months after the Customer notices the fault is considered to have taken place in due time.

Penalties for faulty goods

The customer as a consumer has the right to the following measures if the product is faulty: demand rectification, redelivery, price reduction or compensation to remedy the fault or cancel the purchase. In addition, the consumer may claim damages. The consumer may also withhold the payment. The customer as a trader has only the right to demand that the fault be rectified.

 

Remedial

The Seller is obliged to remedy the error or make a redelivery only if the action is possible and can be taken without unreasonable cost to the Seller.

Remedy or redelivery must take place within a reasonable time after the Customer made his claim and without cost or significant inconvenience to the Customer. Despite the Customer demanding a penalty other than remedy or redelivery, the Seller has the right to take such action, if it can be done under the conditions stated in the previous sentence.

In case of redelivery, the Seller must take back the faulty goods at his own expense. The customer must make the goods available to the seller in the event of remedial action and redelivery. In case of redelivery, however, this does not need to be done until a new item is delivered.

As a consumer, the customer has the right to complain for 3 years. Otherwise, Swedish consumer protection legislation applies, please read more on the Swedish Consumer Agency's website: www.konsumentverket.se .

Any shipping damage must be reported to the shipping company.

8.1 How does the Customer proceed in the event of a complaint?

Any errors must always be reported to kontakt@3dvue.se where the Customer clearly states their name, address, e-mail address, order number and a description of the error.

The seller is responsible for return shipping in the event of approved complaints. The seller also pays for the shipping if the customer wants a new product as compensation.

Complaints or returns where the Seller is responsible for the shipping cost are sent via DHL. It is therefore important that the Customer does not send the Product back until it is agreed that this should happen. The Customer prints out the return slip and attaches it to the package and then hands the package in at a DHL Service Point (agent) or at a DHL terminal.

When the Seller has received the Product, any compensation is paid within 30 days. The payment method for the refund is the same as that used by the Customer at the time of purchase, unless the Parties have expressly agreed otherwise.

If it turns out that the item in question is not faulty in accordance with the applicable legislation, the claim will not be accepted.

In the event of complaints and disputes between a consumer and the Seller, the Seller follows guidelines from the General Complaints Board, see arn.se.

  1. Limitation of liability

The Seller assumes no responsibility for indirect damages that may arise due to the Product, unless required by mandatory legislation.

If the fulfillment of the Seller's obligations is prevented due to circumstances beyond the Seller's control, for example labor dispute, fire, war, authority decision, reduced or non-existent delivery from the supplier, changed legislation or other similar event, this shall form the basis for a release from liability which entails release from damages and other penalties. However, this shall not limit the Customer's rights under the Consumer Purchase Act or other consumer protection legislation.

Furthermore, no responsibility is taken for any changes to Products/Product characteristics that have been changed by the respective supplier and other factors beyond the Seller's control.

The seller is not responsible for third-party applications, plugins, services, products, websites or the like. The seller is also not responsible for external links or the content of external links that appear on the Web store.

The Seller hereby limits its liability for damages towards the Customer to the extent permitted by applicable Swedish legislation.

 

  1. Product information

Any warranty for the Product is stated in the order confirmation. The prerequisite for invoking a warranty/complaint is that it is a manufacturing fault and not a handling fault. The Product Warranty does not apply to defects that occur during or after the Customer's own change to the Product's function and appearance of the Product without written approval from the Seller. The seller is responsible for shipping costs in the case of an approved warranty case.

The seller reserves himself for possible printing errors on the Webshop, Product listings and final sale of Products. Notes and parameter information on the product pages are a guide.

The seller does not guarantee that the images reflect the exact appearance of the Products as a certain color difference may occur depending on the monitor, photo quality and resolution.

The seller always tries his best to display the Products as accurately as possible.

 

  1. Intellectual property rights

The Seller owns all intellectual property rights, copyrights and trademark rights related to the Online Store and its content (with the exception of any intellectual property rights owned by the Seller's licensors or third parties). The Seller does not transfer or assign any intellectual property rights to the Customer or anyone else due to the Purchase Terms. The customer may not copy, reproduce or commercially exploit the Seller's intellectual property rights.

The customer does not have the right to use images, texts or other material belonging to the Seller or its licensors for commercial purposes, without the Seller's prior written approval.

It is considered a material breach of contract to violate the provisions stated above.

  1. Privacy Policy

The seller processes personal data in accordance with the EU Data Protection Regulation 2016/697 ("GDPR"). More information about the Seller's processing of personal data can be found in the Seller's privacy policy: privacy policy .

 

  1. Cookie policy

The online store uses cookies. More information about how the Web store uses cookies can be found in the Seller's cookie policy: Cookies .

 

  1. Messages

Notifications concerning the purchase agreement can be made in writing by e-mail, registered letter or courier to the Parties' specified contact details. Party must confirm received message without delay. The message shall be deemed to have reached the recipient:

  • if sent by e-mail: when a delivery receipt is received proving that the message has been delivered to the recipient's e-mail server.
  • if sent by registered mail: on the third working day after delivery for postal forwarding.
  • if delivered by courier: upon delivery.

  1. Transfer

The seller has the right to, in whole or in part, transfer the purchase agreement, his rights and/or obligations according to the purchase agreement without the Customer's consent.

The customer is not entitled to transfer the purchase agreement, or his rights or obligations under the purchase agreement, without the prior written consent of the Seller.

 

  1. Invalidity of provision

If any provision in the purchase agreement should be found wholly or partially unenforceable or invalid by a general court, arbitration board or the General Complaints Board, this shall not mean that the terms of the agreement are invalid in their entirety. Instead, the current provision in other parts and all other provisions of the purchase agreement shall apply, and the Seller shall make the necessary changes to the terms of the agreement in order to maintain the purpose, structure and spirit of the purchase agreement.

 

  1. Applicable Law and Dispute

Applicable law: The purchase agreement, including the Purchase Terms, must be interpreted in accordance with Swedish law and law.

Alternative dispute resolution method: Disputes that arise between a Customer in the capacity of a consumer and the Seller shall in the first instance be tried to be resolved between the Parties. The customer always has the right to turn to the Allmänna reklamationsnämnden (ARN, www.arn.se , postal address: Allmänna Reklamationsnämnden Box 174, 101 23 Stockholm), which offers an alternative dispute resolution for consumer disputes.

In addition, the consumer can submit complaints online through the European Commission's Digital Dispute Resolution Platform (EU ODR) via the following link: ec.europa.eu/consumers/odr . The customer also has the right to contact the consumer ombudsman ( ko.se ).

If the Seller does not arrive at a solution to the dispute with the consumer through any alternative dispute resolution method, the dispute may be tried and finally decided by a general court in Sweden, unless otherwise follows from mandatory legislation.

General court: If the Customer is a trader, the dispute with the Seller shall be finally settled by a general court in Sweden with the district court in Helsingborg as the first instance.
